Regulatory:
For many years, Corporations have faced a growing number of imposed regulations. These regulations must be adhered to in a consistent and timely way. Regulatory agencies and public auditors assign a high value to the ability to follow audit trails back in time. There are many regulations on the books that are being enforced that pertain to the ethnic and linguistic makeup of each corporation, its subsidiaries and clients.
For instance when you discover that a user is engaging in improprieties, you might need to backtrack through months of data to fully document that user's activities and build a case. A recent survey carried out by SANS Institute found that 44% of system administrators do not keep logs more than a month. This is a major concern for many organizations since regulatory and accounting bodies have strict requirements, sometimes even requiring log retention for three to seven years.
Regulatory bodies and acts such as Basel II, PCI Data Security Standard, Sarbanes-Oxley Act, Gramm-Leach-Billey Act, HIPAA, FISMA, USA Patriot Act, Turnbull Guidance 1999, UK Data Protection Act, EU DPD; all require event retention. Furthermore, they also require event review, for instance NIST recommend a log review at least twice a week. Event logs are the primary source to determine level of compliance and identify deficiencies.
Compliance:
The regulatory department concentrates on identification, analysis and the planning of systematic compliance of all regulations. The compliance department is responsible for ensuring that all regulations are followed as exactly required. Everything is processed and detailed in a systematic way that is documented and is fully transparent for future audits.
Contractual:
On a regular basis Corporation legal departments are working on
a number of contractual matters, writing contracts, revising them, reviewing them are some of the functions. Many departments interrelate with the Corporate Contractual area. These various departments have a wide range of matters to handle included are M & A, leases, purchases, real estate matters and zoning to name some.
Litigation:
Litigation is part of the corporate legal environment. It is often prudent and good business practice to avoid litigation weather it is brought on by your firm or thrust onto you by other business concerns. Sometimes litigation can not be avoided. Therefore, it is imperative that documents be correctly translated as needed in a very timely basis working with the document flow schedule of the Attorneys working on the matter. It is important to have outstanding translators and interpreters to assist in bridging the communication gap so foreign writers/speakers can communicate more clearly for the record in trials, hearings, arbitrations mediations, meetings, etc.
Human Resources:
Human Resource Departments in corporations are often structured directly within the responsibility and scope of the legal department. In some corporations they are a stand alone corporate department. In either case, what is clear is the Corporate HR has role to play in reducing company exposure and limiting potential liability. They are also responsible for keeping personnel records, corporate communications, administrating of benefit plans, retirement plans, Pension plans, sexual discrimination meetings, reviews, exit interviews, training, disciplinary actions, and many other areas.
